Local blogger wins claim against Suffolk Police following unlawful stop and search

A local blogger from Oakham, Martin Brookes, has successfully settled a compensation claim against Suffolk Police following an unlawful stop and search incident last September 2023.

Martin Brookes said that he was "enjoying a day trip to Newmarket, taking photographs and sightseeing, when a member of the public made a false allegation against him."

Mr Brookes goes on to claim that a police officer subsequently stopped him and demanded to see the contents of his camera. Believing this to be an unlawful request, Mr Brookes refused to comply and was subsequently "arrested, handcuffed, and detained in a police car for roughly an hour before being released."

Following the incident, the Rutland resident filed a formal complaint with Suffolk Police.

Mr Brookes explained: "A Police Inspector acknowledged that the officer had acted outside their legal authority and referred the matter to the Norfolk and Suffolk Professional Standards Department for further investigation."

Written apologies were issued to Mr Brookes, who then pursued compensation and recently reached a settlement out of court for an undisclosed but, what he describes as "modest", sum.

While the financial compensation is welcome, Mr Brookes emphasises the importance of securing an official acknowledgement from Suffolk Police that they had acted wrongly.

"It was crucial for me that Suffolk Police recognise the severity of their mistake," he stated. "The compensation will go towards another day trip soon, perhaps not Suffolk, but more importantly, it serves as a reminder that police officers need to operate within the law."

He concluded: "This case highlights the importance of understanding your rights when interacting with law enforcement. If you believe you have been subjected to an unlawful stop and search, it's vital to assert your rights politely but firmly and seek legal counsel if necessary."

Suffolk Police have subsequently said to Oakham Nub News: "We would like to apologise to Mr Brookes whose experience with Suffolk Constabulary fell short of both his and the public's expectations of the police service. As a force we will reflect upon and learn from this incident."
