"With the intent that the Affordable Housing shall remain low cost housing in perpetuity the Developer shall ensure that the sale of every dwelling comprising the Affordable Housing shall be made subject to a restrictive covenant to the effect that :- (i) any future sale of the dwelling shall not be for a consideration greater than the price paid by such future Seller upon his purchase of the dwelling increased or decreased as appropriate in accordance with any percentage change in average national house prices since the date of the said Seller's purchase of the dwelling as calculated by the Halifax Price Index or, in the event of that Index ceasing to be published, as calculated by such other house price index which fulfils the same purpose as shall be agreed between the said Seller and his Buyer of the dwelling."
